SWIFT financial service cuts ties with Iran

BRUSSELS (AP) ? The SWIFT global financial transaction service said Thursday that it was cutting ties with Iranian banks that are subject to European Union sanctions aimed at discouraging the country from developing nuclear weapons.

The action effectively enforces EU sanction because the world's financial transactions are impossible without using SWIFT, and it will go a long way toward isolating Iran financially.

The company's name stands for Society for Worldwide Interbank Financial Telecommunication. It is a banking hub crucial to oil, financial transactions and other trades.

In a statement, SWIFT said the EU decision "prohibits companies such as SWIFT to continue to provide specialized financial messaging services to EU-sanctioned banks."

"Disconnecting banks is an extraordinary and unprecedented step for SWIFT," Lazaro Campos, chief executive of SWIFT, said. "It is a direct result of international and multilateral action to intensify financial sanctions against Iran."

In addition to sanctioning various officials and freezing the assets of certain companies, the European Union plans to institute an embargo on the import of Iranian oil in July ? an attempt to choke off funding for Iran's nuclear program.

The EU sanctions are aimed at forcing Iran to demonstrate to the international community that it is not trying to develop nuclear weapons. Iran says that its nuclear program is for peaceful purposes only, but officials in many other countries ? including Israel ? believe otherwise.

Revenge can be sweet. It can be even sweeter when you use your enemy?s own weapons to extract vengeance.

Six years into the worst wave of foreclosures since the Great Depression, shoddy underwriting and legal shortcuts are coming back to haunt mortgage lenders. Homeowners, sick of being pushed around by the banks, are fighting back, sometimes with David and Goliath results.

In 2008, Jewel Miser and her husband Jack began trying to get Bank of America to modify their mortgage when Jack lost his job after a local auto parts factory closed.

?We were just a month behind then,? said Jewel. ?But I tried every way in the world. And they just put me off and gave me excuses.?

After more than a year of dead ends and red tape, the Sweetwater, Tenn., couple found a lawyer who successfully challenged the shaky paper trail on which the lender relied on to prove it owned the Miser's note. In the resulting settlement, the bank agreed to new loan terms that cut the Miser?s monthly payments by roughly 15 percent, paid their legal fees and stopped the foreclosure.

"I did not want to lose my home," Jewel said. "We had done so much work to it. When you find a home and know it's your home you don't want to lose it. I tried every way in the world."

The Misers and other homeowners who are fighting back in court are using the legal quagmire created by the mortgage lending industry to win loan modifications that lenders have been unwilling or unable to extend voluntarily.

When these homeowners get to court, they find a laundry list of shoddy practices that undercut lenders? legal claim to foreclose, say consumer attorneys who have pursued these cases. Many cases are tainted by ?robo-signers? who failed to properly review files, despite swearing under oath they had done so. Other title claims are undone by improper accounting, including unwarranted fees, and payments that were not credited.

Consumer attorneys also are attacking lenders? effort to paper over missing links in the chain of documents required to prove that a bank owns a loan and has the right to foreclose. Some of those defective paper trails date to the sloppy underwriting that accompanied the frenzy of mortgage lending in the 2000s, when hundreds of now-defunct lenders churned out a blizzard of notes that were instantly offloaded to investors.

?There are more (homeowner) claims because lenders operated in flagrant disregard of the law,? said Diana Thompson, a veteran consumer attorney with the National Consumer Law Center. ?You only have a claim against the lender if the lender didn't do what they were supposed to do.?

Lenders' disregard for the law is still rampant, according to consumer advocates and regulators. Last month, a?survey of 260 consumer attorneys in 45 states by the NCLC found that thousands of homeowners were improperly foreclosed on in just the past year. In more than 80 percent of the cases, the lender scheduled a foreclosure sale while processing a loan modification. In four out of five cases, the attorneys reported, lenders failed to properly credit payments or wrongly claimed homeowners owed bogus fees.

An audit by the San Francisco assessor?s office last month found lenders routinely broke the law in some 400 foreclosure cases over the past three years. Last April, the nation's top two bank regulators, the Federal Reserve and the Office of the Controller of the Currency, reviewed the foreclosure and loan modification practices and found a litany of "deficiencies and weaknesses" that "represent unsafe or unsound practices and violations of applicable law."

Though 49 state attorneys general have settled a sweeping complaint covering a long list of fraudulent and deceptive foreclosure practices, a handful of states are pursuing lawsuits against the mortgage industry. New York Attorney General Eric Schneiderman, named to a federal task force to investigate mortgage fraud, has charged lenders with deceptive and fraudulent foreclosure filings based on a national mortgage electronic registry system, known as MERS. The lawsuit claims that Bank of America, J.P. Morgan Chase and Wells Fargo, ?have repeatedly submitted court documents containing false and misleading information that made it appear that the foreclosing party had the authority to bring a case when in fact it may not have.?

Regulators how vowed to crack down on these practices.?Lenders say they are correcting them.?

"In 2010, we reviewed our?processes and procedures and put in place a number of improvements and worked with our regulators," said Jumana Bauwens,?a Bank of America spokeswoman. "And we continue to improve our processes and procedures."

But lenders still have more work to do,?according to consumer attorneys, judges and mortgage industry professionals. Until reforms are widely adopted, it has fallen to homeowners and their attorneys to try to see that the law is enforced.

Loan modification
Borrowers have been taking their disputes with lenders to court for decades.

The latest efforts have been sparked by rising frustration with other means of trying to get a loan modified, say consumer attorneys. Early in the mortgage crisis, millions of homeowners, encouraged by the industry, tried working directly with lenders.

A succession of government-sponsored programs aimed at providing mortgage relief to millions of borrowers?have fallen far short of promises.

"They (lenders) advertised all the time: 'If you want get your mortgage modified all you have to do is call,'? said Jewel Miser. "I called about 100 times. Each time they would tell me different things or that it was 'in process' - but they weren't doing anything."

In its review, the OCC also cited widespread failings of lenders? "voluntary" mortgage relief efforts. The government?s highly-touted Home Affordable Modification Program (HAMP) has badly underperformed expectations, according to housing advocates and counselors working with homeowners, largely because the decision to modify a loan still rests entirely with the lender.

Bauwens said?Bank of America spokeswoman said that since the Misers applied for their loan modification, the process has been streamlined and reviews and decisions are now made much more quickly.?

"We are in a very much better position to be able to respond to customers modifications in a much more timely manner," the spokeswoman said.

But consumer attorneys said that, in some cases, homeowners are being denied modifications that should have been made under government guidelines.

?Because of the government?s failure to enforce HAMP and failure to hold (lenders) accountable, in many cases in order to get a HAMP modification for which they are complete qualified, homeowners have to hire an attorney and sue their lender,? said Thompson of the NCLC.

That often means a trip to bankruptcy court for a Chapter 13 proceeding, which allows people with a regular income to adjust their debt. Once in court, a foreclosure is typically halted automatically, placing the burden on the lender to have the process re-instated. That forces the lender to prove it owns the mortgage and to account fully for any disputed back payments. When the lender is unable to do so, consumer lawyers say, it is more likely to agree to settle by modifying the loan terms, often by simply lowering the interest charged to current market rates.

Lenders rarely forgive principal, even on homes that are deep underwater, say consumer attorneys. But while bankruptcy law prevents a judge from writing down the primary mortgage on residential property, other loans don?t enjoy that protection.

That means judges often are able to force lenders to take deep losses on second and third mortgages, said Raffi Tal, who advises homeowners facing foreclosure at Los Angeles-based Peak Corporate Network. ?That by itself is a great advantage to borrowers who can afford to make the first mortgage payment - just by canceling the second (mortgage).?

Some bankruptcy courts, including the Southern District of New York, have established special procedures to speed loan modification negotiations between homeowners and lenders.

But it hasn?t been easy.

Consumer attorneys often are outgunned by big banks.?Though more than six million households are either delinquent or in foreclosure, there are fewer than 500 consumer attorneys nationwide who specialize in suing to stop foreclosures, according to the NCLC?s Thompson. As demand for legal help has risen, more lawyers have shifted the focus of their practice to fighting foreclosures. That can include attending seminars focused on the legal arguments used to successfully challenge lenders in court.

For the past six year, Max Gardner has been running "boot camps" out of his Shelby, N.C., farmhouse, training consumer attorneys from across the country in the finer points of turning the mortgage mess to their clients? advantage. More recently, Gardner has been taking these seminars on the road.

On a recent visit to New York, Gardner summoned several dozen lawyers, mortgage industry veterans and a handful of reporters to an intensive weekend crash course in a grab bag of legal strategies. It included a tour deep into the weeds of the Uniform Commercial Code, a subject that has been known to put law students to sleep. Once trained, the more than 200 boot camp alumni in 39 states communicate via listserv, swapping tips and sharing legal opinions that help them build arguments to stop the next foreclosure.

Though they?ve won case-by-case victories for individual homeowners, consumer attorneys such as Gardner say regulators continue to turn a blind eye to improper and illegal foreclosures. The industry has been able to keep regulators at bay, he said, by effectively managing public opinion about its role in the foreclosure crisis.

?I think they've done pretty good job - on the other side - of getting across the message that these are just a bunch of deadbeats trying to get a free home,? he said. ?And that these (wrongful foreclosures) are just the result of technical problems.?

?So let?s just forget about the system of justice, due process and the rules of evidence and everything else. They?re just glitches. They don't mean much,? he said sarcastically.

For borrowers, those glitches can mean the difference between homelessness and holding onto their house. For lenders, the process of fixing those errors can prove costly. Once challenged in court, some lenders decide it's cheaper to settle the case and move on to the next foreclosure waiting in the pipeline.

?I have quite a few cases where the banks just walked away from the foreclosure litigation and either dismissed the action formally or just abandoned the litigation,? said April Charney, a staff attorney with Jacksonville Area Legal Aid, who has defended hundreds of Florida homeowners facing foreclosure since the market crashed in 2006. ??

Homeowner victories in court go largely unreported, however. In some cases, lenders demand borrowers keep quiet as a condition of stopping the foreclosure and settling the case. Other borrowers feel intimidated, say consumer lawyers, fearing the lender could find a reason to restart the foreclosure process again.

?Unless the loan is paid off, there?s always the risk of further fighting,? said Thompson. ?And you just don't want to have the (lender) have a reason to be looking over your client?s payment records with a fine tooth comb.?

Judy Brownell, professor and dean of students at the School of Hotel Administration at Cornell University, says the hotel is onto something. According to her research, women?s hotel preferences are very different than men?s with key priorities being to feel safe, comfortable, empowered, and valued.

?The problem is that in many cases, no action has been taken to meet women?s needs,? she says.

Places like the Naumi Hotel in Singapore, the Premier Hotel in New York, The London Dukes Hotel and the Georgian Court Hotel in Canadian Vancouver, seem to be realizing the potential in catering for women.

The Georgian Court Hotels says their Orchid Floor ? with its special offerings for women such as magazines, curling irons, nylon stockings, bath salts and yoga mats ? has been so successful they?re considering adding a second floor.

At the London Dukes Hotel, management says bookings to their ?Duchess Rooms? ? which are standard rooms with fresh flowers, fruit, styling accessories, and other extras added ? have surged 25% over the past year.

But not everyone thinks this will last ? or that it?s a good idea.

?A lot of hotels will jump along on this fad ? and prove me wrong ? but I think it?s a flash in the pan,? says Marybeth Bond, National Geographic Author and founder of gutsytraveler.com.

She sees it as little more then an advertising gimmick. ?I have seen the hotel industry cater subtly to women without being patronizing, for example by putting shower caps and nail files in the room, and adding a room service menu expanded beyond hamburger and fries to include a big salad. Why not have standard rooms and extras being offered at the front desk? We?ve lived through fighting for our equal rights and this is making us unequal.?

Sanne Udsen, author and consultant on women?s issues and careers, participated in the Bella Sky survey and sees no problem in targeting women as a segment. ?A lot of hotel services are geared towards men,? she says. ?If you want to sell three-wheelers you target them at two-year-olds,? she says.

But Bond is not the only one who sees a problem. Denmark?s gender equality board has ruled the women-only floor in Bella Sky Hotel discriminatory and illegal, following a complaint by a man. The hotel has been ordered to close the floor, but Mikkelsen refuses, saying he is prepared to take the case to court. ?It?s no different then women having their own cycling club. Discrimination and disagreements aside, the bottom line, says Judy Brownell, is that women will likely reward hotels that are ?listening? to their preferences.

?This comment may stir controversy but that?s okay. My personal guess, having focused on this subject for several years: Men see the beer and nuts and go, ?Wow, food! This is great!? Women see the smoothies and fruit and go, ?I love this place ? they were thinking about my preferences.?

But she adds, ?It?s important for hoteliers to recognized that separate floors are just one way to address the situation.?

Lawsuit: US Cellular workers looked for nude pics

Lisa Blazek, who worked as a retail consultant at a store in the northwest Iowa city of Spencer from 2007 to 2010, alleges the first thing employees did when customers brought in their phones for service was to scroll through their photos to "try and find naked or sexually explicit photos."

"If photos of that nature were found, they would show them throughout the store," Blazek wrote in a complaint with the Iowa Civil Rights Commission, filed as part of an amended lawsuit in federal court last week. Blazek's lawsuit said that being subjected to customers' sexual photos was just one of many troubling aspects in a workplace where she said there was non-stop sexual harassment, which was then covered up by the company after she complained.

Blazek alleges two male co-workers frequently talked about their own sex lives and those of customers and asked her about her genitalia and sexual positions she favored. She also alleges that one told her to show him her breasts. After she complained to the store manager, she said he told her she'd have to deal with it since she was the one who was bothered, she claims, and also warned that his job would be in jeopardy if she complained to higher-ups.

She said her hours were changed so she wouldn't have to work with the worst offender, but no one was disciplined.

In fact, she said the harassment got worse after she reported it. The lawsuit claims a company investigator falsely accused her of having a relationship with one of the harassers and attempted to coerce her into abandoning her allegations. Blazek says she was told she would have to relocate to another office to avoid harassment. She decided to quit instead after two years of problems.

"It got to the point where I could no longer handle going to work," Blazek wrote in the complaint. "It affected me physically, mentally and emotionally. It took over every aspect of my life."

Blazek is seeking to be compensated for lost pay and health benefits, suffering and emotional distress and additional punitive damages to deter similar conduct in the future.

Munger said Blazek, who is married and has two young sons, has gone back to school and does not have another job. He said believes he will be able to prove her claims at trial and declined comment on whether he believed similar practices went beyond the Spencer store.

A duo of Nashville Symphony musicians performed two sessions for second and third graders at Rossview Elementary School in Clarksville.

There are more than 35 similar performances slated for this year in Davidson, Wilson, Williamson and Rutherford counties.

Seven of the Americans had a travel ban imposed on them. All but one of them left Egypt on Thursday after the U.S. posted almost $5 million in bail and the ban was lifted. The U.S. has said the decision about whether they return should their appearance at court be demanded was up to each individual.

State Department spokesperson Victoria Nuland said in a statement Saturday that the NGO issue is a matter of serious continuing concern for the United States, but affirmed that relations with Egypt are "strong."

"Despite the recent strains, and differences on certain issues, the fundamentals of this strategic relationship remain strong," she said.

She said the United States continues to support the efforts of the IMF to conclude an economic reform program with Egypt. The country is seeking a loan agreement for over $3 billion, a much-needed financial boost amid the ongoing economic crisis.

The case against the democracy groups brought U.S.-Egyptian relations to their lowest level in decades, with American lawmakers threatening to withhold the country's $1.5 billion aid package.

The sudden turn-around, including the swift lifting of the travel ban following extensive U.S.-Egyptian negotations, has sparked public anger against the ruling military council. It has renewed calls to purge the judiciary of Mubarak-era officials accused of trying to compromise judicial independence.

This reopens an old issue in Egyptian politics, but with a new twist: ousted President Hosni Mubarak was frequently accused by his critics of subverting judicial independence to suppress Egyptian democracy advocates, while his successors are now accused of manipulating the judicial system to let American democracy advocates go free.

Critics of the military council say that they are not pressing for the Americans' prosecution and that their guilt or innocence is not the issue, but that judges should decide the case rather than U.S. pressure.

Egypt's newly elected parliament on Saturday said it will question the prime minister on March 11 over the reasons behind lifting the travel ban and whether the judges looking into the case came under political pressure.

Local newspapers have reported that lawyers have filed independent suits against Egypt's military ruler Field Marshal Hussein Tantawi and other officials accusing them of collaborating in helping the Americans to flee justice.

Outrage about a suspected deal spiked after three judges hearing the case abruptly pulled out on Tuesday citing "uneasiness." The presiding judge Mohammed Shukry hinted in interviews with Egyptian dailies that he was subject to pressure.

Senior judge Abdel-Moez Ibrahim said in a state TV interview that Shukry's son was asked to step down because he had partners who worked for the U.S. Embassy, and this could make it difficult for him to judge the case impartially. Shurky denies that his son works with anyone linked to employees at the U.S. Embassy.

The state-run Al-Ahram daily meanwhile quoted an unnamed government official as saying that lifting the travel ban on the Americans was part of a deal struck between the ruling military generals and the U.S. government. The report could not be verified independently.

According to the report, the official said the United States will help Egypt secure $50 billion in aid from U.S. and Arab countries and will help speed up the IMF loan, in addition to another $3.4 billion from the World Bank.

Egypt's economy has reeled from the overall effect of the uprising, with net international reserves down 50 percent year-on-year by the end of December.

'American Idol' announces 13 finalists

(AP) ? "American Idol" is down to the top 13 singers.

Smooth 21-year-old pawn shop worker Phillip Phillips of Leesburg, Ga., quirky 22-year-old nonprofit organizer Heejun Han of New York, and spunky 18-year-old country crooner Skylar Laine, from Brandon, Miss., were among the finalists revealed Thursday on the Fox singing contest. They and seven others received the most viewer votes after the 13 male semifinalists performed Tuesday and the 12 female semifinalists sang Wednesday.

The other viewer-selected finalists included soothing 18-year-old vocalist Hollie Cavanaugh, of McKinney, Texas; 20-year-old alt-rock musician Colton Dixon, of Murfreesboro, Tenn.; 25-year-old "gentle giant" Jermaine Jones, of Pine Hill, N.J.; booming 19-year-old student Joshua Ledet, of Westlake, La.; soaring 16-year-old vocalist Shannon Magrane, of Tampa, Fla.; 16-year-old Jessica Sanchez, of San Diego; and soulful 28-year-old teacher Elise Testone, of Charleston, S.C.

"America, you're on fire, because this is an amazing top 10 brewing," said judge Randy Jackson.

Once the fan favorites were all revealed, the show's panel picked five remaining semifinalists to deliver a last-chance tune in hopes of becoming one of the judges' "wild card" selections. The judges ultimately chose 17-year-old student Deandre Brackensick, of San Jose, Calif.; 19-year-old receptionist Jeremy Rosado, of Valrico, Fla.; and 26-year-old disc jockey Erika Van Pelt, of South Kingstown, R.I., to be among the top 13.

"I love somebody who can fight through the tears and still deliver," judge Jennifer Lopez told a weepy Van Pelt.

The finalists will return to the stage to sing next Wednesday for the first round of season 11's finals. "Idol" host Ryan Seacrest announced Thursday that the male singers would perform Stevie Wonder songs, while the female contestants would pay tribute to the late Whitney Houston, who died last month.

Leap year: What a difference a day makes

There will never be another day like today ? at least not until 2016. Today's date (Feb. 29) pops up on the calendar only on leap years, once almost every four years.

It has taken millennia for our calendar, called the Gregorian calendar after the pope who modified it in 1582, to evolve to include this tweak ? 97 leap years every 400 years. There are other alternatives, according to Yury Grabovsky, an associate professor in the department of mathematics at Temple University, who has studied the history and mathematics of the Gregorian calendar.

Leap year addresses a discrepancy between our 365-day calendar and the time it takes the Earth to circle the sun. The discrepancy: It takes 365.24219878 days for the planet to complete one trip, so over time, our calendar and the astronomical one fall out of step.

The oldest Babylonian calendar consisted of 12 months, based on the cycles of the moon. At 354 days per year, it fell a fair number short of the astronomical year. The ancient Egyptians brought this calendar up to 360 days, and later, added five days at the end of each year, according to Grabovsky. ?

More than 3,000 years later, in 238 B.C., the Egyptian king Ptolemy III introduced a sixth day at the end of every fourth year ? the original leap year. Julius Caesar learned of this change and included it when he reformed the existing Roman calendar, added the leap day to February in his new Julian calendar.

But adding an extra day every four years didn't fully solve the problem. The remaining discrepancy was small, showing up only as the calendar and the seasons gradually fell out of sync.

"The calendar was making a one-day error in 100 years," Grabovsky said.

Over the centuries this became apparent.

"I think the records show it became evident around the 10th century, about 1,000 years after Julius Caesar's time. The 10-days' error would have accumulated and astronomical observations even at the time were able to find the 10-day error," he said. "But it took another more than 500 years before an official political change could be made."

In 1582, Pope Gregory XIII decreed that October would lose 10 days, so Oct. 4 would be immediately followed by Oct. 15. However, Protestants rejected this change for nearly 200 years. In 1752, Sept. 2 was followed by Sept. 14 in Great Britain and its colonies.

The pope also tweaked the leap-year cycle to address the remaining one-day-per century drift: Years ending in "00" are not leap years unless they can be divided exactly by 400, so 2000 was a leap year, while 1900 was not. (Hence the 97 leap years over 400 years.)

Grabovsky has used continued fractions ? fractions in which the denominator, or bottom number, is expressed as a whole number plus a fraction with its own denominator that is a whole number plus a fraction, and so on, iteratively ? to examine the ways a calendar could be constructed to handle the discrepancy between the astronomical year and the calendar year.

The 400-year cycle Pope Gregory XIII installed accumulates an extra 26 seconds each year, resulting in an error of a full day every 3,320 years, he calculated. He compares this to a 500-year cycle, which would be 17 seconds shorter than the solar year, resulting in an error of one day each 5,031 years ? an alternative the pope appears to have missed either because he didn't do his math or because astronomical measurements at the time weren't precise enough to justify this cycle, Grabovsky writes.

Another alternative, based on a 900-year cycle, is too complicated and has an inconveniently long cycle.

A tiny amount of error remains in the Gregorian calendar, and to correct for most of it, he recommends canceling leap year every 3,200 years.

"The new system would accumulate a one day error in 100,000 years, that is never," he writes as part of a presentation he gave on Feb. 29, 2000.

To add to the complication, the planet's speed along its orbit isn't constant, so occasionally, leap seconds are added to our clocks to compensate.
